Estudio Ferrero's environmental team is integrated by lawyers with expertise in the field of environmental law and policy at both, the national and the international levels. Our staff understands the importance of good environmental management of business and the value of corporate sustainability in the present days. While the Peruvian environmental legislation has had important developments during the last decade, the most relevant progress in terms of administration and enforcement has been made in the mining, metallurgic and hidrocarbons sector.

 

Most of our clients in the mining and metallurgical business rely on us for the management of the legal aspects related to their environmental obligations and commitments. Our work in this regard includes permitting, risk assessment, evaluation and management of liabilities, legal aspects of mines closure, environmental guarantees, EIA, Environmental Management and Adjustment Programs (PAMA), social responsibility, litigation, among others.

 

From 2001 to 2003 we assisted Sociedad Minera La Granja S.A. (SMLG) in the closure of the La Granja project, which included both a technical closure as well as a "social closure". Our team helped SMLG to implement a social program which included the resettlement of approximately 700 campesino families (former owners) back in the area, and the establishment of a foundation for the sustainable development of the region. The process was conducted in accordance to the highest international standards and regulations.

 

Also in the social aspect, we are currently assisting BHP Billiton Tintaya S.A. in its negotiations with indigenous communities on land issues. As a consequence of these negotiations, the company has created a working space to deal with the communities and is progressing towards reaching an agreement with the province of Espinar. Likewise, we have assisted the Company in the development of a Convenio Marco (framework agreement) for the mutual benefit of the parties and the reinforcement of the company's social license.
